What Happens After an ART Hearing: Decisions, Timeframes and Next Steps
The hearing isn't the end of the road. Here's what actually happens afterwards — and what each possible outcome means for your plan.
Key points
- The hearing isn't the end of the road.
- Here's what actually happens afterwards — and what each possible outcome means for your plan.
The decision usually comes later
Don't expect an answer on the day. In most NDIS matters the Tribunal member reserves their decision and delivers it in writing — sometimes weeks later, occasionally a few months for complex matters. You'll receive a written decision with reasons, and the NDIA receives the same.
Occasionally, where the evidence is straightforward and both sides have had their say, a member may indicate an outcome at the hearing — but the written decision is the document that matters.
What the Tribunal can decide
The ART steps into the NDIA's shoes. It can affirm the original decision (nothing changes), vary it, or set it aside and substitute a new decision — for example, finding that a support is reasonable and necessary and must be funded. It can also send the matter back to the NDIA with directions to remake the decision.
A win at the ART flows back into your plan: the NDIA must implement the Tribunal's decision, which usually means a plan variation reflecting what was ordered.
If it's not the outcome you hoped for
A further appeal to the Federal Court is possible, but only on a question of law — not simply because you disagree with the outcome. That's specialist legal territory, and getting advice before going down that path is essential.
Whatever the outcome, the evidence built for the Tribunal rarely goes to waste. Reports written for an ART matter usually become the foundation of the next plan reassessment — the functional picture doesn't stop being true because one proceeding ends. Our NDIS ART review assessments page covers how we support matters at every stage, including after a decision.
