Most NDIS ART Matters Resolve Before a Hearing — Here's Why
The picture most people have — a tense hearing room — is usually wrong. Most NDIS matters at the ART end in agreement well before a hearing.
Key points
- The picture most people have — a tense hearing room — is usually wrong.
- Most NDIS matters at the ART end in agreement well before a hearing.
The process is built to resolve
After an application is lodged, the ART lists the matter for case conferences — structured discussions between you (and your supports) and the NDIA, facilitated by the Tribunal. The aim is to narrow the dispute: what can be agreed, and what genuinely needs a member to decide.
Many matters resolve at this stage entirely. The NDIA's own review of fresh evidence, or an agreement reached in conference, means the hearing never happens.
Strong evidence is what tips matters into agreement
There's a pattern behind matters that settle: the applicant lodges clear, specific, independent evidence that directly addresses the decision's reasoning. Faced with a well-reasoned clinical report answering its own stated concerns, the NDIA frequently reconsiders rather than defending the original decision to a hearing.
This is the practical case for getting evidence early rather than waiting for a hearing date. The same report that would win at a hearing often ends the matter months earlier — with less stress, less cost and faster access to the supports.
Settlement doesn't mean settling for less
Resolving by agreement isn't a compromise unless you accept one. You can negotiate, refuse inadequate offers, and proceed to a hearing at any point. But when the NDIA agrees to fund what the evidence supports, you've won the substance — just without the wait.
If you're weighing up an ART application, our NDIS ART review assessments page explains how targeted evidence fits the process at each stage.
