NDIS ART Review Deadlines: Check Your Decision Notice Before Waiting for Reports
Your decision notice is the starting point for checking review rights and timing. Do not delay seeking advice while waiting for clinical reports.
Key points
- Your decision notice is the starting point for checking review rights and timing.
- Do not delay seeking advice while waiting for clinical reports.
Check the notice and contact the ART
The ART reviews most eligible NDIA internal-review decisions. Read the decision letter or email for review rights and timing, and check promptly with the Tribunal or an independent adviser if anything is unclear. Do not rely on a general deadline quoted in a blog article.
Do not wait for a finished report to seek advice
Tell your adviser what evidence is already available and what is still being assessed. Ask how to make the application and when further documents can be provided under the Tribunal’s directions. A clinical report should not be the reason you delay checking an application deadline.
If you think you are late
Contact the ART or an independent legal or advocacy adviser promptly about your options. Do not assume an extension will be granted or that a plan reassessment is a substitute for review of the decision. These are different processes.
Keep deadline advice separate from clinical assessment
Check the review rights and deadline in your own decision notice with the ART or an independent legal or advocacy adviser. Our occupational therapy role is clinical evidence; we do not determine your legal deadline or guarantee an extension.
